Subject: Investigator Susalis

Mr. Kurt Krauss,

I received a phone call today from Nick Susalis today. He claimed to be an independent investigator hired by your firm. You are apparently his contact at the firm. Mr. Susalis asked that I provide him with information regarding victims of misconduct at Delbarton School.

I told him that I would be willing to discuss how I might assist after he answered two questions. He said he would call me back, and he did so, but provided no answers.

Here were my two questions, and a few more:

1. Does Mr. Susalis’ investigation supersede the investigations that Michael Critchley’s office is conducting?

2. What will your office do with the information it receives?

By my count, Delbarton/St. Mary’s is working with lawyers (Broderick, Critchley, Carella, Krauss) from four different law firms.

3. Are all of these firms funneling their misconduct information back to Mr. Susalis, as he told me? If not, can you help define the roles of each firm?

4. Is Ann Ordway no longer investigating this matter?

When I asked how the victims would benefit from his investigation, Mr. Susalis told me that the abbey would provide the victims with “whatever support they need.” When I asked him whether he was authorized to make such a statement, he paused, then said, “All I can tell you is that I am the investigator.”

5. Is Mr. Susalis authorized to tell victims that the Abbey/School will provide the victims with “whatever support they need”? If so, how is “whatever” defined?

I am currently awaiting a response from Governor Chris Christie on this matter. He has documents which are critical to this matter and I am hopeful that he will broker a credible, truly independent investigation which puts the needs of the Abbey/School’s victims and potential targets ahead of all else.

What happened today was not a step in that direction.

I look forward to your timely response.

Sincerely,

Patrick J Marker
